In this action for unpaid rent under a lease of commercial premises and other relief, the defendants, Bernard Guay and Bemie’s Repair Service, LLC (Bernie’s), appeal from the judgment of the trial court rendered in favor of the plaintiff, A and M Towing and Recovery, Inc. The defendants’ principal claim on appeal is that the trial court improperly awarded damages to the plaintiff for unpaid rent despite the plaintiffs failure to have a certificate of occupancy for the property, as required under General Statutes § 29-265 (a), 1 during the defendants’ occupancy.
