The principal question involved in this appeal is whether the finding of the trial court that a quitclaim deed was not given as a mortgage to secure the payment of certain indebtedness is against the clear weight of the evidence.

This action was commenced in the district court of Nowata county on January 2, 1930. The plaintiff, State of Oklahoma ex rel. 0. Graves Shull, Bank Commissioner, sought to recover on behalf of the Sapulpa State Bank (a failed state bank in the process of liquidation) a money judgment against H. H.
