GILLIAM, District Judge.
This action was instituted against several defendants, but prior to the hearing a dismissal was entered with respect to all defendants other than Frederick L. Toepleman and Garland Greenway.
The claim of the Government is made under'the False Claims Act, Title 31 U.S. C.A. §§ 231-233. Section 231 reads, so far as pertinent here: “Any person * * * who shall make or cause to be made, or present or cause to be presented, for payment or approval, to or by any person * * * any claim upon or against the .
