MEMORANDUM OPINION AND ORDER
HOOD, District Judge.
This matter is before the court upon several pending motions. The defendant, Ronnie C. Moore, the Commissioner of the Kentucky Department of Insurance (the Commissioner), has moved to dismiss the complaint. [Record # 4]. The intervening defendants (collectively referred to as “the associations”) have also filed a motion to dismiss. [Record # 7].
