MEMORANDUM AND ORDER

MacLAUGHLIN, District Judge.

This matter is before the Court on defendant’s motion for partial summary judg ment. Also before the Court is plaintiffs appeal from the December 5, 1985 order of the United States Magistrate. The Court will affirm the Magistrate’s order and will grant defendant’s summary judgment motion in all respects.
