BRUGGINK, Judge.

Plaintiff Ronald Keith Carpenter seeks award of attorney fees under the Back Pay Act, 5 U.S.C. § 5596 (1988 & Supp.1993) (“BPA” or “Act”), and an order requiring defendant to reinstate him in his previous position, to issue him a revised performance evaluation for 1992, and to cease retaliation against him. The case is presently before the court on defendant’s motion to dismiss for lack of subject matter jurisdiction.
