OPINION

LEDERBERG, Justice.

This matter came before the Supreme Court on the appeal of Capital Properties, Inc., from a judgment of the Superior Court sitting without a jury. Capital Properties, Inc. (CPI), had petitioned the Superior Court for an assessment of damages following the condemnation of its land by the State of Rhode Island (state) in the course of implementing the Capital Center Project.
