This matter comes before the Court on defendant Graco Children’s Products, Inc.’s Motion for Summary Judgment (Doc. # 41) filed on February 18, 2005. Plaintiff Sylva Pinchinat filed her Memorandum of Law in Opposition to Defendant’s Motion for Summary Judgment (Doc. # 51) on March 14, 2005. The parties submitted an affidavit, depositions, and other materials in support of their respective briefs.
