RULING ON DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

ZAMPANO, District Judge.

In this products liability diversity action arising from injuries sustained when a re volver manufactured by defendant fell to the floor and discharged, plaintiff has asserted three causes of action: (1) negligence, (2) breach of warranty, and (3) strict liability. Defendant pleads as a special defense that the action is time-barred, and moves for summary judgment.

The relevant dates for the purposes of this motion are as follows:
