INTRODUCTION
This matter is presently before the court on the motion for summary judgment filed by defendant, Sargent & Greenleaf, Inc., (“Sargent & Greenleaf”) pursuant to Rule 56 of the Federal Rules of Civil Procedure. Plaintiff Providence & Worcester Railroad Company (“Providence & Worcester”) initiated this diversity action seeking damages for a train derailment which it alleges was proximately caused by the failure of a switchlock sold to it by Sargent & Green-leaf.
