Plaintiffs are husband and wife who own vacant residential property in the city of Palos Verdes Estates, county of Los Angeles. They desire to construct on their property a single family residence.

A petition for a writ of mandate was filed in the trial court seeking to compel the issuance of a building permit to enable them to proceed with the construction.
