[1] This is an action brought by the Assistant Prosecuting Attorney of Greene County, seeking to have condemned and destroyed a certain pinball machine, designated by the alliterative and euphonious cognomen, "Jack and Jill." It is alleged in the petition, after giving a meticulous description of the operation of the machine, that it "is a gambling device, adapted, designed and intended for the purpose of playing thereon or therewith, a game of chance for money or property."
