ORDER

LOZANO, District Judge.

This matter is before the Court on Defendant Judge Dywan’s Motion to Dismiss and For Entry of Final Judgment, filed on October 28, 1998, and Plaintiffs Verified Motion for Disqualification of the Honorable Judge Rudy Lozano, filed on December 18, 1998. For the reasons set forth below, the motion for disqualification is DENIED and the motion to dismiss is GRANTED. The Clerk is ORDERED to DISMISS Defendant Judge Jeffery J. Dywan from this case.
