Appellant entered mixed pleas before a military judge sitting alone as a general court-martial. He was convicted of one specification of assault upon a noncommissioned officer with intent to cause grievous bodily harm, in violation of Article 128, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 928 (2000), and two specifications of wrongfully using cocaine, in violation of Article 112a, UCMJ, 10 U.S.C. § 912a (2000).
