This suit was commenced in the district court of Love county, Oklahoma, on the 20th day. of December, 19<li8, by the plaintiff, Sherwood Gaines, against J. E. Montgomery, defendant, and is an action in ejectment asking for possession of the S. W. Vi of the S. E. % of section 21, Tp. 6 S., R. 3 E., of Love county, Oklahoma; alleging that the plaintiff was a Chickasaw freedman, and that the lands described above were allotted to him as such freedman, and that J. E. Montgomery was holding said land adversely and without any legal right and had held the same for a term of two years, and…
