This is an appeal from a judgment in favor of plaintiff declaring a resulting trust in real property standing in the name of defendant.

By the amended complaint it is alleged that on November 3, 1917, and for a long time prior thereto, plaintiff was the owner and in possession of certain real property “subject to a first mortgage in the principal sum of $11,000, and to a second mortgage in favor of the defendant in the principal sum of $5000”; that on said date the owner of said first mortgage began an action to foreclose same; that defendant proposed to plaintiff, who was her sister and who…
