The plaintiff seeks to recover for injuries sustained when, on the evening of January 8, 1958, she fell on a public way. She alleged (count 1) that Bossano Construction Company, Inc. (Construction), negligently collected water upon city land upon which it was erecting concrete walls and negligently discharged water in definite channels, by means of holes in such walls, into the street, where it formed an artificial accumulation of ice.
