Appellant was convicted of murder in the second degree, and his punishment assessed at imprisonment in the penitentiary for a term of five years; hence this appeal.
Appellant made a motion for continuance which was overruled. After conviction he made a motion for new trial, and among other assignments, is the error of the court in refusing to grant the continuance. This motion for continuance is based on the absence of the following witnesses: Tom Jeffries, Dan Biley, Miss Buth Denton, Frank Segars, and Arch Bouser.
