This is an original proceeding to review an award made by tbe State Industrial Commission to Fred H. Koon, an employee of the State Highway Commission. Neither the nature of tbe employment nor the nature and extent of tbe injury is in dispute. The State Highway Commission, seeks to vacate the award and has presented tbe sole issue that the accidental injury did not arise out of and in tbe course of tbe employment.
