This action was brought to recover damages for alleged malpractice by a physician, concerning treatment for a back injury, and from a judgment non obstante veredicto of no cause of action for defendant, plaintiff appeals, and defendant cross-appeals.

Jack Miles, plaintiff, 27 years of age, suffered an injury to his back March 26, 1959, in lifting a box of picnic hams from the cooler at a supermarket where he worked in Muskegon.
