This is an appeal by plaintiff General Insurance Company of America from an order granting defendant Olivia Schian’s motion to release from the levy of an attachment certain funds deposited in an escrow account.
The facts are without dispute.
On October 16, 1956, defendants Harvey and Olivia Schian, husband and wife, entered into a written contract with the County of Kern to install certain improvements in a tract which they were desirous of subdividing.
