— Affirming.

On February 1, 1897, the city council of the city of Elizabethtown passed an ordinance whereby it was ordained that airy person, partnership, or corporation should be given the privilege to erect and operate a telephone system and exchange within the corporate limits of the city by paying to the city treasurer the sum of ¡$100. Certain regulatory provisions were incorporated in the ordinance, none of which is pertinent to the questions involved in this case.
