This is an appeal from an order granting a new trial. The action was commenced by appellant to recover the sum of $75,000 deposited by respondent with an escrow holder pursuant to the terms of a written contract for the sale of real property. After hearing the evidence the trial judge made findings and entered judgment for appellant, but later, on respondent's motion, granted a new trial on the ground of insufficiency of the evidence to justify the decision and that the decision was against the law. We have concluded that the order granting a new trial was proper, and therefore affirm.
