PAINE, District Judge.
This matter comes before the Court upon the Motion to Dismiss Defendant’s Counterclaim and for Final Summary Judgment filed by the Plaintiff, BIRDSALL, INC., as agent for TROPICAL SHIPPING (“BIRDSALL”) (DE 11).
BACKGROUND
On January 11, 1991, BIRDSALL filed suit against TRAMORE TRADING CO., INC. (“TRAMORE”) for $19,815.38 in ocean freight due on six December 1989 shipments of cantaloupes, plus interest, costs, and attorneys’ fees. See Complaint (DE 1). TRAMORE answered (DE 6) and filed a Counterclaim…
