The defendant has appealed from a judgment which was rendered against him for one-half of the commissions or profit derived from the sale of real prop*639erty pursuant to an oral agreement which, he had with the plaintiff by the terms of which a joint adventure was created with relation thereto.
The complaint alleges that the plaintiff and the defendant were duly licensed real estate brokers in Madera, and that they entered into an agreement “whereby they engaged to use their joint efforts to consummate the purchase and sale of certain real property”, and “in event they were successful in…
