This was an action on an oil and gas drilling contract. Judgment was in favor of the plaintiff, and defendant appeals.

On December 21, 1928, the defendant, Helmerich & Payne, Inc., owned a block of oil and gas mining leases in McPherson county, Kansas. Plaintiff, the Boggs Oil and Drilling Company, was a drillT ing contractor.
