From a judgment of the district court of Grant county rendered and entered March 1, 1910, sustaining a demurrer to their petition wherein they substantially state that defendant in error, as county clerk of said county, had, after filing, failed and refused to transmit to the county attorney of said county for a ballot title their petition in due form of law and unchallenged for insufficiency, which they file as an exhibit, calling for a referendum vote on the action of the board of county commissioners of said county in ordering the clerk of said board to advertise in a certain…
