This case for alleged negligence causing injury to a three year old child comes to the Law Court on motion for new trial, based on claim of newly discovered evidence. The action was tried at the May 1954 term of the Superior Court for Somerset County, before a jury, which resulted in a directed verdict for the defendant. Exceptions were taken, but not completed as required by the docket entry, and judgment was ordered for the defendant by the presiding justice at the September term, 1954.
