On October 3,1995, the appellant in Thomas v. Brown, U.S. Vet.App. No. 95-993, filed a Notice of Appeal (NOA) as to an August 29, 1995, decision from the Board of Veterans’ Appeals (BVA or Board). On February 8, 1996, the Court in Thomas in a single-judge order, inter alia, construed the appellant’s November and December 1995 pleadings as a petition for extraordinary relief and noted that, under Mayer v.
