Plaintiff brought this action to recover upon a policy of insurance or membership certificate issued to Beryl Otto Williams by the Black Hills Benefit Life Association wherein plaintiff is named as beneficiary. The application for the insurance was taken by Florabelle Lewis, the agent of the defendant association. Prior to taking the application upon which the present policy is based this same agent had taken an application for insurance by the insured in the South Dakota Underwriters of Doland, South Dakota.
