Appeal from Circuit Court, Yankton County, Hon. E. G. Smith, Judge. Action by Sylvanus J. Thomas and others against the Modem Brotherhood of America. From a judgment for plaintiffs and an order denying a new trial, defendant appeals.

This is an appeal by the defendant from a judgment entered in favor of the plaintiffs and from an order denying a new trial. The action was instituted by the plaintiffs as beneficiaries under a policy of insurance issued to Sarah A. Thomas. ' The complaint is in the usual form, and the answer of the defendant, after making certain admissions and denials, seis out various clauses in the application for the policy, and also certain clauses in the policy itself, and alleged that the insured made false answers to certain questions propounded to her, and that under and by the terms of the various…
