TEHAN, Chief Judge.

Plaintiff seeks to recover damages from defendants by reason of certain allegedly wrongful and malicious conduct on the part of defendants as officials of the Town of Milwaukee.

On September 28,1950, the defendants caused to be served upon the plaintiff an order determining that the building owned by the plaintiff “is so old, dilapidated, out of repair, unsafe, unsanitary and otherwise unfit for human occupation, occupancy or use that it is unreasonable to repair the same.” The order required the plaintiff to remove the building within twenty days, and provided that in the…
