This is a civil action in which the plaintiff, Kay Construction Company (“plaintiff’) has brought suit against defendant, Control Point Associates, Inc. (“Control Point”) for breach of contract, negligence, indemnity for losses, and unfair practices under G.L.c. 93A, §11.
