— Affirming in part and reversing in part.

This action was brought by tbe Dorset Company against tbe City of Newport, tbe Chesapeake & Ohio Railway Company, tbe Louisville & Nashville Railroad Company, tbe Kentucky Highway Commission and tbe Codell Construction Company to recover $70,000 damages alleged to have been done plaintiff’s milling plant located in Newport as tbe result of tbe reconstruction of Monmouth street so as to eliminate a grade crossing over tbe tracks of tbe two railroad companies.
