THIS MATTER comes on for consideration of Defendant City of Albuquerque’s Motion for Summary Judgment filed February 7, 1994 (doc. 94) and Supplemental Motion for Summary Judgment filed July 5, 1995 (doc. 110). Plaintiff seeks damages under 42 U.S.C. § 1988 and just compensation under the Fifth and Fourteenth Amendments to the United States Constitution.
