Petitioner has applied for a writ of mandate to compel the respondent superior court to hear and determine a contempt proceeding instituted by her against her former husband.

On October 19, 1937, petitioner commenced an action for divorce against her husband, C. T. Plummer, and on the same day the parties entered into an agreement providing for the settlement of their property rights, and for stipulated monthly payments to. be made by petitioner’s husband to her for her support and maintenance, and forever releasing him from any other claims.
