Defendant was convicted in a court trial of possession of heroin. ORS 475.854.1 Before trial, he moved to suppress evidence of statements that he had made in response to questions by investigating officers. Defendant contended that he made those statements in response to interrogation conducted under compelling circumstances and that, under Article I, section 12, of the Oregon Constitution, the officers’ failure to provide him with Miranda warnings before that interrogation required suppression of those statements.
