FeRguson, Judge:

Tried by general court-martial convened at Fort George G. Meade, Maryland, the accused was found guilty of aggravated assault, whereby grievous bodily harm was intentionally inflicted, and two counts of simple assault, all in violation of Uniform Code of Military Justice, Article 128, 10 USC § 928. He was sentenced to dishonorable discharge, forfeiture of $100.00 per month for thirty-nine months, and confinement at hard labor for thirty-nine months.
