Homer Ferguson, Judge:

The accused was convicted by a special court-martial of a $5.00 larceny, in violation of Article 121, Uniform Code of Military Justice, 10 USC § 921. He was sentenced to a bad-conduct discharge, partial forfeitures, reduction in grade, and confinement at hard labor for three months. The convening authority approved the findings but only that portion of the sentence adjudging a bad-conduct discharge. Thereafter, the officer exercising general court-martial jurisdiction and the board of review affirmed the findings and the sentence. The issues before us…
