OPINION AND ORDER
HEWITT, Judge.
Before the court is defendant’s Motion to Dismiss on grounds of issue preclusion. Plaintiff Richard P. Watson was an officer in the United States Navy discharged under the military’s Don’t Ask/Don’t Tell (DADT) homosexual exclusion policy after fourteen years of service. First Amended Complaint (Complaint) ¶ 1; see also 10 U.S.C. § 654 (DADT policy).
