The United States District Court for the District of Oregon certified for immediate appeal its denial of a motion for partial summary judgment. Foster v. Hallco Mfg. Co., 14 USPQ2d 1746, 1989 WL 138740 (1989) (Frye, J.). Foster filed a declaratory judgment action seeking, inter alia, a declaration of invalidity and unenforceability of Hallco’s patents, U.S. Patent Nos. 4,143,-760 (’760) and 4,184,587 (’587).
