OPINION
HORN, Judge.
This case comes before the court on defendant’s motion to dismiss, or, in the alternative, for summary judgment and plaintiffs cross-motion for summary judgment. Plaintiff enrolled as a midshipman at the United States Naval Academy on July 2,1985. Academically, he performed acceptably at the Naval Academy, participated in the political science honors program, and pursued a number of extra-curricular activities.
