OPINION OF THE COURT
BECKER, Circuit Judge.
The question presented by this appeal is whether the district court erred in refusing to afford defendants John Torcomian and Albert Torcomian a jury trial with respect to both the complaint of plaintiff Amoco and the Torcomians’ compulsory counterclaim. The basis of the denial was that the claims, which arose out of the parties’ dealings concerning an Amoco service station, were equitable in nature.
