THE COURT.

This appeal is from a judgment in favor of the defendant Moses, whose demurrer to the complaint was sustained without leave to amend. A purported appeal also has been taken from an order denying plaintiff’s motion to file an amended complaint.

From the allegations of the complaint on file herein, it appears that some time prior to the filing of the instant action, at the instance of the defendant Moses and his employer, the West American Finance Company, the plaintiff surety com pany had issued a fidelity bond in a sum not to exceed $10,000, under the terms of which the surety…
