MEMORANDUM AND ORDER

ALDRICH, District Judge.

This is an insurance contract case, between plaintiff Parker Hannifin Corporation (“Parker”) and defendant Steadfast Insurance Company (“Steadfast”). The dispute arises over the extent of Steadfast’s liability for damages paid by Parker following the malfunction of certain Parker products. On January 4, 2002, the court denied Steadfast’s motion to dismiss Count II of Parker’s complaint (Docket No. 24).
