This matter is before the Court on the Motion for Summary Judgment (Do'c. 69) of Defendant American Guarantee & Liability Insurance Company (“American Guarantee”) and the Motion for Partial Summary Judgment (Doc. 70) of Plaintiff Big Lots Stores, Inc.
