Plaintiff Frank Bilello, on behalf of himself and all others similarly situated, brings this lawsuit under the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1001 et seq., and the Internal Revenue Code (“I.R.C.”). Bilello was an employee of JPMorgan Chase & Co. (“JPMC”) and predecessor banks, including Chemical Banking Corporation (“Chemical”), from 1960 until his retirement in 2008.
