On March 12, 2012, the Plaintiff Janet D’lorio (the “Plaintiff’) commenced this action by filing a Complaint against the Defendant Winebow, Inc. (the “Defendant”). The action sought statutory, in-junctive, and equitable relief relating to the Defendant’s alleged failure to disclose plan documents and its affirmative and/or negligent misrepresentation of benefits under its longterm disability and life insurance plan governed by the Employee Retirement Income Security Act of 1974 (“ERISA”).
