In its bill in equity in this case the plaintiff is seeking a decree of court under the Federal Declaratory Judgment Act, 28 U.S.C. § 400, 28 U.S.C.A. § 400, to determine the rights, obligations and duties of itself and of the defendant respectively under a written contract between them dated September 11, 1931, relating to a license and royalty payments under United States Patent to C.
