WADDILL, Circuit Judge.

This action was instituted in the superior court of Currituck county, N. C., to recover damages-for personal injuries sustained by the defendant in error, plaintiff in the court below, while in the employ of the plaintiff in error, defendant below, and by appropriate proceedings was removed into the United States District Court at Elizabeth City, where it was tried, and resulted in a verdict in favor of the plaintiff against the defendant. The parties will hereinafter be referred to by their titles in the lower court.
